CAN THE COURT TAKE AWAY MY CHILD FOR HAVING A MESSY HOUSE?

I have full custody of my son but my ex-husband is making threats to take away my child for having a messy house. Can I lose custody for having a messy house?

ANSWER

No, you will not lose custody just based on having a messy house. A lot of people have messy houses. Now, if your house is unsanitary and prevents a danger to the health of its occupants, then your house is not just “messy.” Is the trash where it belongs, does the plumbing work, are any animal droppings picked up and cleaned, is there any mold or mildew, or is anything decomposing (food or animal)? Your house has to be way beyond “messy” to lose your kids.

All that being said, it can’t hurt to tidy up a little on a regular basis so that it won’t be an issue with your ex.
